Compliance Heat Map Illustrates Similarities and Differences in State Laws, with Virginia’s Being Most Strict; Laws Hint at Myriad of Data Compliance Challenges Facing Businesses of All Sizes
OAKDALE, Minn.--(BUSINESS WIRE)--Aug. 28, 2012-- Imation Corp. (NYSE: IMN), a global scalable storage and data security company, today released results of research into state data breach notification laws and associated penalties. The analysis shows that current state data breach notification laws are strikingly similar but vary in compliance requirements for businesses, with all laws highlighting the need for companies to deploy methods for closely storing, protecting and controlling sensitive information. Imation used publicly available sites (including information obtained via the National Conference of State Legislatures) to analyze state compliance laws in the 46 U.S. states that have such laws, as well as in Puerto Rico, the District of Columbia and the U.S. Virgin Islands.
Imation created a “Compliance Heat Map” to depict the strictness of data breach laws and resulting penalties for breaches. The Compliance Heat Map provides a visual snapshot of the strictness of regulations by state, using a color scale ranging from light yellow (less strict) to dark red (more strict). “What the compliance heat map tells us is that data security needs to be at top of mind for all IT pros, as there are rules in place for nearly all states and territories and non-compliance could mean serious penalties,” saidDavid Duncan, software & security solutions marketing director, Imation. “Yet, companies also are challenged by explosive data growth and state and federal requirements that mandate active archiving, long-term retention and accessibility of that data. IT pros today are responsible for managing data, which includes ensuring security, business continuity and regulatory compliance. For small- to mid-sized businesses, the challenge is often to meet compliance requirements with limited resources, which leads to higher risk. In fact, the 2011 Verizon Data Breach report found that businesses with between 11 and 100 employees reported more than six times as many data breaches than businesses with between 101 and 1,000 employees, according to the online websiteBusinessNewsDaily. Further, the loss or theft of an unencrypted notebook, flash drive or removable hard disk drive can expose gigabytes, or even terabytes, of private information. IT professionals should implement strategies to protect their data through network security, data encryption and enforcement of information security policies, while staying well-informed of state compliance laws in the not-unlikely event that a data breach does occur.
Compliance Heat Map Findings
Imation’s research found most state data breach notification laws to offer similar definitions of personally identifiable information and requirements regarding the notification of affected parties. Among the research’s noteworthy findings:
  • Four states have yet to enact a data breach notification law: Alabama, Kentucky, New Mexico and South Dakota.
  • According to Imation’s analysis, Virginia has the most strict law in the nation. The law provides specific requirements on what is to be included in a breach notification, requires government and credit reporting agency notification, and includes a large financial penalty relative to other states.
  • A few states, including Virginia, require notification even if breached data is encrypted—if the encrypted data was stolen along with the encryption keys.
Compliance Heat Map Methodology
To conduct the research, Imation applied to the laws a series of questions, organized to evaluate the laws’ requirements regarding encryption, data that is within scope of the laws, notification of data loss and destruction of data, as well as penalties for non-compliance with the laws. Imation also considered other germane laws, such as those dictating data destruction or allowing for consumer freezing of credit report requests. Imation used publicly available information about the laws, including the legislation itself.

All IRS Tax Audits Not Created Equal
H&R Block advises compliance contacts don’t have to be costly

Data for last year shows the IRS audited the tax returns of approximately 1 percent (1.6 million) of taxpayers. However, further inspection indicates that the tax returns of an additional 6.5 percent (9.2 million) of taxpayers were subjected to recently defined type of compliance contact. The National Taxpayer Advocate called these compliance contacts “unreal” audits in a recent blog post1.

No matter what an IRS notification or compliance contact is called, H&R Block advises on the benefits of having professional assistance when responding to an IRS notification. 
The 9.2 million taxpayers who were notified the IRS had recalculated their taxes due, also could have been assessed added penalties and late fees. The notifications happened for the following reasons:
  • 4.7 million returns were corrected for math errors
  • 3.9 million returns were determined to have underreported income based on third-party reporting, which is done by employers, banks, etc.
  • 600,000 substitute returns were filed by the IRS on behalf of taxpayers based solely on income reported by third parties, perhaps resulting in taxpayers not claiming the tax credits and deductions to which they are entitled.

 “While it might seem the only appropriate response to an IRS notification is to pull out the checkbook, it’s important to understand the request,” said Elaine Smith, H&R Block tax professional and enrolled agent. “The IRS has several ways it corresponds with taxpayers to correct underreporting errors. So, not all audits are created equal.”
H&R Block, which prepares approximately 1 in 7 tax returns nationally, also provides audit services to current and new clients. Only enrolled agents, certified public accountants and lawyers may represent taxpayers through the entire IRS audit process. H&R Block employs the nation’s largest single staffing of enrolled agents, who have experience with audits involving hundreds to millions of dollars. In fact, in an audit situation H&R Block is able to reduce the overall tax liability for 3 out of 5 taxpayers whose returns were not prepared by H&R Block.
Audits hit all income levels
The primary targets of audits are no longer small business owners and those whose income exceeded $1 million; 64 percent of the 1.5 million taxpayers audited in 2010 earned $50,000 or less, including taxpayers who claimed the Earned Income Tax Credit, but were not eligible. This means an overwhelming majority of taxpayers subjected to audits and other forms of compliance contact are low- and middle-income taxpayers. Following are other factors that may make taxpayers attractive audit candidates:
  • Handwritten returns
    • Miscalculations and omissions that could be avoided by using tax preparation software and e-filing can cause even the most straightforward returns to be audited
  • Unreported income and inconsistencies
    • A document-matching program makes it easy for the IRS to check income stated on a tax return against what is reported on forms W-2 (wages), 1099-MISC (self-employment income),1099-INT (interest paid), 1099-B (sale of stock), etc.
    • The IRS also uses a program to compare taxpayers’ deductions (e.g., mileage and charitable contributions) with others in the same tax bracket to check for inconsistencies
  • Schedule C (self-employment form)
    • Returns are more likely to be audited if they include claims for expenses not within the IRS’s guidelines and include a majority of cash business transactions.
Like audits, not all tax preparation companies are created equal. (Kansas City, Kan., March 27, 2012) - EPA has issued a notice of violation to Grain Processing Corporation, Inc. (GPC), alleging the company has violated the Iowa State Implementation Plan and the federal Clean Air Act for issues related to construction and operating permits issued for its facility at Muscatine, Iowa.

EPA Region 7 has coordinated with the State of Iowa on the notice of violation, which is separate from a civil lawsuit filed December 1, 2011, by the Iowa attorney general, which alleges that GPC's facility violated the state's air pollution laws.

GPC’s plant at 1600 Oregon Street in Muscatine processes corn into ethanol, corn sweeteners and beverage alcohol.

EPA’s notice of violation to GPC specifically alleges that between 2007 and 2011, its facility repeatedly violated limits on air emissions opacity that were set forth in the company’s 1995 amended construction permit and 2003 operating permit. The notice further alleges GPC failed to notify the Iowa Department of Natural Resources of the opacity exceedances, and failed to address the exceedances in its annual compliance certifications for the years 2007 through 2011.

EPA’s notice to GPC does not address penalties, but indicates the Agency will consider additional enforcement action, which could include penalties, to ensure the facility complies with applicable laws and regulations. The notice can be viewed online at www.epa.gov/region7/newsevents/legal.

The notice was accompanied by an official request for information, which seeks details of GPC’s compliance with the Facility Response Plan requirements and Spill Prevention and Countermeasures Control requirements of the federal Clean Water Act. Information provided by the company in response to EPA’s request will be used by the Agency in evaluating GPC’s compliance. GPC’s response to EPA’s information request is due within 15 days.
