For Buckyballs Toys, Child Safety Is a Growing Issue
By ANDREW MARTIN
Three years ago, two pals from Brooklyn came up with the idea of creating a desktop toy out of powerful magnets. Their creation, Buckyballs, became an instant hit. And by this year, the two — Craig Zucker and Jake Bronstein — had expected annual sales to reach about $25 million.
But their business plan has hit a major, unanticipated snag.
Buckyballs are made from rare-earth elements, which makes them much more powerful than most magnets — and potentially more dangerous when ingested. Though the product is marketed to adults and festooned with warning labels, regulators have moved to stop sales because children keep swallowing Buckyballs and similar products made by others.
An administrative complaint filed last month by the Consumer Product Safety Commission seeks to require the company — officially called Maxfield & Oberton Holdings — to tell the public about the problem and offer customers a refund. The safety commission also asked 12 other manufacturers of rare-earth magnets to voluntarily recall their products and stop sales; 11 have complied.
Besides Buckyballs, Zen Magnets, a small company in Denver, refused. Last week, the safety commission filed an administrative complaint against Zen Magnets too.“The labeling, the warnings, the packaging does not work,” Scott Wolfson, spokesman for the safety agency, said of the products. “You have young children who come into a room and get their hands on a loose magnet or two.”
The action involving Buckyballs and Zen Magnets is unusual because the safety commission rarely files an administrative complaint, which is essentially a request for a mandatory recall. The last one, filed 11 years ago, was against Daisy Manufacturing, which makes BB guns. In Buckyballs’ case, a hearing will be scheduled before an administrative law judge, who will decide whether to grant the safety commission’s request.
In the meantime, Mr. Zucker has started an aggressive public campaign to win support for Buckyballs. Using the cheeky slogan “Save Our Balls,” his company has taken out newspaper ads in Washington, directed at President Obama and lawmakers, and stoked a campaign on social media Web sites like Facebook and Twitter.
In doing so, Mr. Zucker has found enthusiastic support from those who believe the Obama administration has pushed regulation too far.

Emulex to Continue Redesign of Products
Emulex to Continue Redesign of Products Impacting Five Percent of Net Revenues
Court Approves Continued Shipment of Impacted Products Worldwide
COSTA MESA, Calif., March 19, 2012 – Emulex Corporation (NYSE: ELX) today reported the continued implementation of design changes for products impacted by the issuance of an injunction for two patents by the U.S. District Court for the Central District of California in the lawsuit filed against Emulex by Broadcom Corporation (NASDAQ: BRCM), based on U.S. revenues for sales of impacted products that were about five percent of Emulex’s net revenues for its second quarter of fiscal 2012. The injunction included a “sunset period” of 18 months for Emulex to continue selling impacted products in the US without design changes. Based on the jury assessment of royalties, and the terms of the injunction, Emulex estimates a charge of approximately $600,000 in liability for damages to Broadcom to its third quarter fiscal 2012 GAAP results. This amount is in addition to the $387,922 in liability previously reported by Emulex for that patent during the first quarter of 2012.
For its second fiscal quarter which ended on January 1, 2012, Emulex reported net revenues of $128.7 million, 76 percent (or $97.8 million) of which came from outside the US based on billed-to location. For the second fiscal quarter of fiscal 2012, the net revenues in the US for products impacted by issuance of the injunction were approximately $7 million. The design changes primarily focus on serializer/deserializer (SerDes) modules, which Emulex does not design but obtains from several suppliers, and which are included in impacted Emulex products. The impacted Emulex products include BE2, BE3, XE201, SOC 320, SOC 422 and SOC 442 ASICs, and products containing those ASICs.
“Emulex is dedicated to protecting the interest of its customers,” said Jim McCluney, the Chief Executive Officer of Emulex. “We have been working with our suppliers to implement design changes to the SerDes modules included in the impacted products.”
Broadcom had earlier asserted 12 different US patents against Emulex. Emulex presented a vigorous defense prior to the trial, and only 6 patents remained by the time of trial. After three weeks of trial, the court determined that one of the patents (7,058,150) had been infringed by Emulex, and the jury rendered an advisory verdict to the Court that it is not invalid, and awarded $387,922 in damages with respect to that patent. Subsequently, the judge determined that a second patent (7,471,691) had been infringed by Emulex. With respect to the remaining four patents, the jury found one not infringed and could not reach a unanimous verdict on the other three. Emulex intends to continue to vigorously defend its products, including a potential appeal.

Yazaki North America Selects PTC as Its Software Systems Solution for Electronic Instrumentation
Press Releases
Yazaki North America Selects PTC as Its Software Systems Solution for Electronic Instrumentation
NEEDHAM, Mass., March 19, 2012 - PTC (Nasdaq: PMTC) today announced Yazaki North America, Inc., a Tier 1 automotive supplier, has selected PTC as the software systems platform for its electronic instrumentation.
Software and electronics cost in a vehicle
In today's highly competitive automotive industry, software is quickly becoming an important differentiator as automobiles increasingly include advanced instrumentation and high-definition displays. The business research firm Frost and Sullivan estimates that cars will require 200 million to 300 million lines of software code in the near future. As a global supplier of vehicle power and data solutions, Yazaki recognized the increased significance and volume of software in its products and realized that the complexity of its product development processes could not be effectively managed with the current infrastructure. The company recognized the value of a solution that enables global software development collaboration and code reuse.
"Yazaki chose PTC's Integrity software because it offers a single software engineering platform that can manage process complexity and support strategic quality, compliance, collaboration, and release readiness initiatives," said Larry Engelhardt, senior product manager electronics and instrumentation business unit, Yazaki North America.
Integrity integrates well with Yazaki's other product lifecycle management applications. Key to Yazaki's decision was PTC's commitment and certification of Integrity for developing safety related systems in ISO 26262 compliant development processes, an automotive safety mandate that requires safety-related embedded systems to qualify the tool chain being used to produce these systems.
Continues Engelhardt, "Yazaki products depend on the quality of the software that drives them. PTC's Integrity enables us to better manage the increasing complexities of electronic instrumentation. With this integrated approach we are able to quickly make better design decisions so we can rapidly deliver innovative new products to our automotive customers."
"Yazaki is one of many automotive customers using Integrity as the platform for the collaborative integrated development of software systems," said Andrew Wertkin, chief technology officer, PTC. "PTC understands that successful management of embedded systems can provide a strategic business advantage for manufacturers. We look forward to working with Yazaki to drive greater value to its automotive OEM customers using this technology."

Trademarks Take On New Importance in Internet Era
By STEPHANIE STROM
PRINCETON, N.J. — As a serial snack-food entrepreneur, Warren Wilson is no stranger to the challenges of running a business.
In the early days of his first enterprise, selling funnel cakes at fairs, there was the time when, tired of losing money on inclement days, he bought weather insurance — and proceeded to lose even more money than he had when it rained. In the 1990s, he and his wife and business partner, Sara, once had to mortgage their house and sell off investments to make their company’s payroll.
But it still came as a bit of a shock when the Wilsons made what they thought was a routine move to register the trademark of their hot product — a flat pretzel snack called Pretzel Crisps — and it was contested by none other than Frito-Lay, the 800-pound gorilla of the snack food market owned by PepsiCo.
“This is so different from anything else we’ve faced because we’re not fighting a product in the supermarket, we’re not fighting against an institution like a bank, we’re not dealing with an act of nature,” Mr. Wilson said in an interview at his company’s headquarters here. “This fight is about a big company that wants to dominate the snack food category by crushing a little company like ours rather than by competing with us.”
Frito-Lay, whose Rold Gold pretzel products and Stacy’s Pita Chips compete with Pretzel Crisps, declined to discuss the case, citing the pending dispute with the Wilsons’ company, Princeton Vanguard.
But in its filings with the Patent and Trademark Office, Frito-Lay contends that Pretzel Crisps cannot be registered as a trademark because it is a generic term. “Like ‘milk chocolate bar,’ the combination of ‘pretzel’ and ‘crisp’ gains no meaning as a phrase over and above the generic meaning of its constituent terms,” the company wrote in a 2010 motion.
The dispute is still pending with the trademark office’s trial board.

America's Next Top Energy Innovator, Round 2
News release from the U.S. Department of Energy:
Secretary Chu Announces Second Round of “America’s Next Top Energy Innovator” on One Year Anniversary of the White House Startup America Initiative
January 31, 2012
WASHINGTON, D.C. – Today, on the one year anniversary of the Obama Administration’s Startup America Initiative, U.S. Energy Secretary Steven Chu announced that the Department of Energy (DOE) is kicking off a second year of “America’s Next Top Energy Innovator,” a program that allows startup companies to license groundbreaking technologies developed by DOE’s 17 national laboratories for $1,000 and build successful businesses. As part of this effort, the Department reduces both the cost and paperwork requirements for startup companies to obtain an option agreement to license some of the 15,000 patents and patent applications held by the national laboratories.
The White House Startup America Initiative is a multiagency effort across the Obama Administration to promote high-growth entrepreneurship by expanding access to capital, cutting red tape, and accelerating innovation through agency action. Additional information on the program’s one year anniversary and new steps the Obama Administration is taking to support job-creating small businesses is available HERE.
“America's future competitiveness depends on our ability to innovate and advance American products and businesses,” said Energy Secretary Chu. “Through America’s Next Top Energy Innovator, we are allowing brilliant ideas to fully develop and giving startup companies the opportunity to bring inventions from our national laboratories to the market.”
Under the previous round of America’s Next Top Energy Innovator, thirty-six companies in total signed option agreements with the national laboratories. An online contest for the top picks is currently underway, where Americans can vote online for the most innovative and promising technologies supported by the program by visiting www.energy.gov/topinnovator. The top startup companies– based on the public vote and an expert review – will be invited to be featured at the premier annual gathering of clean energy investors and innovators around the country, the ARPA-E Energy Innovation Summit at the end of February.
Under the next round of the “America’s Next Top Energy Innovator” program:
1. Wednesday, February 1, 2011, the Department will kick off the second round of the competition. Entrepreneurs and start-ups must identify the technology of interest and submit a business plan to be considered for the program. Participants will have until December 10, 2012 to make their submission to the laboratory.
2. Any of the 15,000 unlicensed patents and patent applications held by the national laboratories will be available for licensing by startup companies.
3. From February 1 to December 10, the Department will reduce the total upfront cost of licensing DOE patents in a specific technology to a $1,000 upfront fee for portfolios of up to three patents from a single laboratory. This represents a savings of $10,000 to $50,000 on average in upfront fees.
4. Other license terms, such as equity and royalties, will be negotiated on a case by case basis and will typically be due once the company grows and achieves commercial sales. These fees help support the Department's continuing research activities to develop new technologies.
5. The Department has simplified the option and licensing process and has established a standard set of terms for start-ups, who generally lack the resources, time or expertise to negotiate individual licensing agreements.
6. In early 2013, the Department will give Americans the chance to vote online for the most innovative and promising technologies supported by the program.

Gartner conducted a primary research survey of 547 IT leaders in organizations (excluding technology and service providers) in 11 countries in the second half of 2010. More than half the organizations surveyed have adopted OSS solutions as part of their IT strategy, with nearly one-third citing benefits of flexibility, increased innovation, shorter development times and faster procurement processes. Lower total cost of ownership was a key driver.*
"Enterprises are increasingly using Linux in integrated systems, ranging from consumer electronics, to industrial control, aerospace and military technologies," said Nils Brauckmann, president and general manager, SUSE.
"This partnership marks another milestone in our ongoing relationship with Dell. It combines Dell's OEM product, industry standard hardware and global services capabilities, with SUSE's flexible, reliable and cost-effective operating system and tools, to meet the specific needs of the embedded and OEM markets."
Dell will use SUSE Studio, a powerful image customization and provisioning tool, to build and deploy application stacks based on SUSE Linux Enterprise Server onto Dell OEM Solutions’ embedded, built-to-order and customized solutions. Using SUSE Studio, Dell can help its OEM customers reduce the complexity and overhead costs associated with bringing integrated systems to market.
“We are pleased to welcome SUSE as the first Linux vendor to the Dell OEM Technology Partner Program.
