American Thwarted in Quest to Build a Ski Resort in India

MANALI, India — To John Sims, the Himalayas, with some of the finest mountain slopes in the world, seemed like the perfect place to build India’s first Western-style ski resort.

But he got his first clue about the uphill challenge he faced when the local gods — or at least the holy men who claimed to speak for them — came out against his project here.

In the seven years since, Mr. Sims, an American hotel developer with years of experience working in India, has encountered seemingly endless setbacks.

Some opponents claimed falsely that the 115-acre project would take over the entire valley. Others complained that the developers had underpaid landowners for their property. The state of Himachal Pradesh, which had once championed the $500 million proposal, moved to scrap it after a different political party took over. Now, a court has allowed it to go forward but has given the developers just six months to secure environmental permits from a government that has repeatedly stalled the project.

“My fundamental complaint is only this: Why did you invite us?” Mr. Sims said. “Why did you take our deposit? Why did you encourage us to spend money and then make a 180-degree turn?”

It is not easy for any company to do business in India, with its mercurial and ponderous decision-making, creaky court system and woeful infrastructure. Witness the immense blackouts of late July, in which the electric grids serving half of the country’s population collapsed under the strain of the hot summer and too few power plants. The World Bank ranks India 166th out of 183 economies in the ease of starting a business.

But the story of the Himalayan Ski Village shows the particular difficulties faced by foreign companies.

Says United States Should Adopt Simpler System with Lower Corporate and Individual Rates and Territorial System
WASHINGTON, D.C.—U.S. Chamber of Commerce Executive Vice President for Government Affairs Bruce Josten issued the following statement today ahead of the U.S. corporate tax rate becoming the world’s highest on April 1, 2012:
“In just a few days, the United States will hold the dubious distinction of having the highest corporate tax rate in the world. By simply standing still, we are falling behind. We need fundamental, comprehensive tax reform to improve our tax system, strengthen the economy, and help American companies compete and win.

“The United States tax system is increasingly out of step with the world economy and its competitors’ tax systems. As countries such as Canada and the United Kingdom have moved to reform their tax systems and lower rates to encourage economic growth, America’s inaction puts American worldwide companies at a competitive disadvantage and threatens our economic recovery.

“The Chamber believes now is the time for comprehensive, fundamental tax reform that lowers the individual and corporate rates and keeps them synchronized. Reform should also shift to a territorial tax system, bring taxpayers certainty, simplify the tax code, and provide adequate transition rules to get our tax code from where it is now to where it should be.

“Ultimately, the marketplace, and not the tax system, should allocate capital and resources. We can’t allow our tax code to continue to punish American businesses and taxpayers. We need reform and we need it now if we are serious about driving economic growth, creating jobs, and enhancing American competitiveness.”

Increased consumer spending and foot traffic boost expectations

SCOTTSDALE, Ariz.--27 March 2012-- The American restaurant industry is starting to simmer. Consumers are spending more on meals, and foot traffic at establishments is improving, albeit from a diminished base, according to the 22nd edition of the Chain Restaurant Industry Review, released at this week’s Restaurant Leadership Conference by GE Capital, Franchise Finance. As sales trends recover, operators are translating those positive feelings into a greater willingness to invest in their businesses. And with increasingly accessible credit, they’re able to commit to higher capital expenditures.
“The restaurant industry has come through the upheaval of the past several years by listening closely to the consumer and adapting to their changing tastes – and they’ve done it well,” said Agustin Carcoba, president and CEO of GE Capital, Franchise Finance. “Depending on their segment, brand and focus, operators have emphasized food quality, service quality, menu options and other factors that will lead to renewed growth this year and in the years ahead. Even better, operators did it all while managing operational costs.”
Consumers spent $406.6 billion at restaurants in 2011. For 21 consecutive months, they spent more at restaurants than grocery stores, and that trend is expected to continue. Last year, quick-service restaurants (QSR) accounted for 48.0 percent of that figure, while full-service restaurants (FSR) counted for 48.1 percent. The QSR category includes limited service, fast casual, take-out locations and snack and non-alcoholic beverage bars, while FSR includes family, casual, high-end casual and fine dining establishments.
Operators’ improved expectations can be partially attributed to positive results that were sustained throughout last year. QSR same-store sales grew 3.2% last year – ahead of the FSR rate of 2.4%. QSR benefitted from eight consecutive periods of growth due to more consistent traffic, while FSR relied more on menu price increases and higher average checks.
“Restaurateurs are no longer in survival mode; now they’re planning for the future,” said Trey Brown, commercial leader of GE Capital, Franchise Finance. “To capture that growth and maintain a competitive advantage, they’re investing in their businesses by building new stores, remodeling existing ones or investing in new equipment.”
The level of liquidity available in the restaurant space continues to improve. Merger and acquisition activity – an indicator of the popularity of the restaurant industry among investors – increased last year. Total syndicated volume in the restaurant space increased more than 26% to almost $12 billion in 2011. Strategic buyers returned, such as American Blue Ribbon Holdings LLC, Darden Restaurants and Landry’s Inc. Private equity firms were also active; for example, Golden Gate Capital acquired California Pizza Kitchen.
“We expect restaurants to continue to be appealing acquisition targets because of the ongoing increases in food dollars spent away from home, as well as the scalability of this business model,” Brown added.

Recently FDA-Cleared Systems Provide Versatility, Advanced Imaging for Interventional Cardiology Procedures in the OR
CHICAGO – March 26, 2012 – GE Healthcare unveiled two recently FDA-cleared systems aimed at providing versatility and advanced imaging for interventional cardiology at the American College of Cardiology (ACC)’s 61st Annual Scientific Session & Expo, March 24-27 in Chicago.
Specifically, GE highlighted its recently FDA-cleared Discovery* IGS 730 system, the first interventional X-ray system designed to capture the advantages of both floor- and ceiling-mounted systems. Initially introduced last fall, the Discovery system was designed to address the trade-off departments have historically needed to make between ceiling- and floor-mounted systems, eliminating the need to compromise on patient access and image quality. The Discovery IGS 730 is a revolution in imaging. It is neither floor- nor ceiling-mounted, but enables full patient access without the need to suspend the system above the patient. It has the mobility of a C-arm with the power and image quality of a fixed system. This laser-guided, motorized mobile gantry creates an interventional environment without boundaries. It allows complete access to the patient and unlimited parking capability, while creating sterility for a flexible and secure OR environment. The unique gantry comes with a new wide bore design, which allows for steep angles, ease in 3D acquisition, especially for large patients.

GE will also introduce the FDA-approved Innova* IGS 520/530 with the OR option to expand the use of its Innova imaging system in the hybrid OR setting. Thanks to a specifically designed table and accessories, the Innova IGS 520/530 OR enables both transcatheter and open surgical procedures in the one room.
GE is also highlighting its Innova HeartVision solution to help support device localization and guidance during structural heart procedures, especially TAVR procedures. The HeartVision function fuses in real time 2D X-ray images and 3D models, such as the 3D cardiac model, from multiple modalities. It can be synchronized with ECG gating and can help compensate for patient heart and respiratory motion throughout the procedure for quality treatment. Innova HeartVision can reduce procedure time and dose, and increase physician confidence by providing the visual tools to make challenging interventions more accessible.

The Card will roll out in more than 1,100 stores across the United States in the coming weeks(1) and provide Office Depot customers with a smarter spending and budgeting tool that can be used anywhere that American Express® Cards are accepted.

The temporary one-time load Card(2) is available for purchase for $4.95 in more than 1,100 Office Depot stores nationwide or free online at americanexpress.com/prepaid. The temporary Card can be funded with multiple loading options at the register with any dollar amount from $25 to $500.
Customers can order their permanent Card with full benefits online at the Card's website with no fees for monthly maintenance, activation, balance inquiries, alerts, Card replacement, foreign currency conversion or loading via bank account or direct deposit. Once Cardmembers receive their permanent Card, funds can be loaded online through a bank account, such as savings or checking account, direct deposit, and through cash loading(3) via MoneyPak or the Vanilla Reload Network by InComm, a new loading option for the Card. The permanent card comes with ATM access and there is no fee from American Express for the first monthly ATM cash withdrawal, after which a $2.00 fee applies per withdrawal (bank network charges may also apply to any ATM cash withdrawal). Permanent Cardmembers also have the ability to create, manage and specify additional user cards for others such as family members, colleagues, babysitters and contractors.
The temporary card can be used anywhere in the United States that American Express is accepted and the permanent card can be used internationally. The funds on the temporary and permanent card do not expire, and if lost or stolen, the funds can be replaced.
New Features for the American Express Prepaid Card
In conjunction with today's announcement, American Express is also rolling out new features on the permanent American Express Prepaid Card. Available today, these include:
  • Direct deposit: American Express Prepaid Cardmembers can now load their Card, up to $5,000 monthly, from their paycheck using direct deposit. This feature allows Cardmembers the ability to set up recurring loading directly from their employer.
  • Increased Limits on ATM Cash Access: The ability to access cash is an important feature for consumers with general purpose reloadable cards. In response to consumer demand, American Express Prepaid Cardmembers can now withdraw up to $400 per day from ATMs.
  • Additional Cash Loading Options: Cardmembers can now load their Cards via cash using the Vanilla Reload Network by InComm at Office Depot locations or other participating locations nationwide, giving American Express Prepaid Cardmembers the convenience and ease of more reload options.
Benefits and Protections
Permanent Cardmembers are also entitled to valuable protections and benefits (subject to terms and conditions), including:
  • Purchase Protection(4) which can protect against accidental damage or theft of eligible items for 90 days from date of purchase, up to $1,000 per occurrence and up to $50,000 per Cardmember account per calendar year.
  • Roadside Assistance which provides dispatch services including towing, battery recharge, gas delivery, locksmith service and changing a flat tire.
  • Global Assist ® Services provide trip planning assistance as well as emergency assistance when the Cardmember is traveling more than 100 miles from home.

Sales at Sit-Down Restaurants Suggest a Rising Economy

Have you been eating more at restaurants with waiters rather than fast-food joints?

If so, you are not alone, and that in fact is an indication that the American economy is improving.

Over the 12 months through January, sales at what the government calls full-service restaurants were 8.7 percent higher than in the previous 12 months. That was the fastest pace of growth since the late 1990s, when the economy was booming. Moreover, as is seen in the accompanying charts, that rate was much greater than the rate of growth in sales at limited-service restaurants.

Since those numbers became available 20 years ago, that difference has been a reliable indicator of how the economy is going. In tough times, people may still eat out, but they cut back.
