The former owner of a Los Angeles-based medical supply company was sentenced today to seven years in prison for his role in a fraud scheme that resulted in $3.3 million in fraudulent claims to Medicare.
Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division, Acting U.S. Attorney Stephanie Yonekura of the Central District of California, Special Agent in Charge Glenn R. Ferry of the U.S. Department of Health and Human Services Office of Inspector General’s (HHS-OIG) Los Angeles Region and Assistant Director in Charge David L. Bowdich of the FBI’s Los Angeles Field Office made the announcement.
Hakop Gambaryan, 55, of East Hollywood, California, was convicted following a jury trial on March 20, 2015, of four counts of health care fraud. In addition to the prison sentence, U.S. District Court Judge Otis D. Wright II of the Central District of California ordered Gambaryan to pay $1,740,009 in restitution.
At trial, the evidence showed that Gambaryan, the former owner of a durable medical equipment supply company, fraudulently billed more than $3 million to Medicare for durable medical equipment, such as expensive power wheel chairs, that was not medically necessary. Medicare paid approximately $1.7 million on those fraudulent claims.
The evidence demonstrated that between March 2006 and December 2012, Gambaryan paid cash kickbacks to medical clinics for fraudulent prescriptions for durable medical equipment, which the patients did not need. Gambaryan then used these prescriptions to bill Medicare for the unnecessary equipment.
According to evidence presented at trial, Gambaryan personally delivered power wheelchairs to many beneficiaries who were able to walk without assistance. In one instance, Gambaryan carried a power wheelchair up a flight of stairs for a woman who lived in a second floor apartment with no elevator. In another instance, the power wheelchair would not fit inside the beneficiary’s home, so Gambaryan put it in the beneficiary’s garage.
The evidence also demonstrated that Gambaryan generated false documentation to support the fraudulent claims, including fake home assessments when no home assessments actually occurred. In addition, Gambaryan photocopied beneficiaries’ signatures hundreds of times to create the appearance that the beneficiaries consented to ongoing equipment rentals, when they did not. Indeed, at least two of the beneficiaries had passed away prior to the date they supposedly signed the rental agreements.
The case was investigated by the FBI and HHS-OIG and was brought as part of the Medicare Fraud Strike Force, under the supervision of the Criminal Division’s Fraud Section and the U.S. Attorney’s Office of the Central District of California. The case was prosecuted by Trial Attorneys Fred Medick and Ritesh Srivastava of the Criminal Division’s Fraud Section.
Since its inception in March 2007, the Medicare Fraud Strike Force, now operating in nine cities across the country, has charged nearly 2,100 defendants who have collectively billed the Medicare program for more than $6.5 billion. In addition, the HHS Centers for Medicare & Medicaid Services, working in conjunction with the HHS-OIG, are taking steps to increase accountability and decrease the presence of fraudulent providers.

Wells Fargo will contribute $100,000 to the American Red Cross, and work with officials in the affected areas to distribute $175,000 in aid to local non-profits to support additional recovery efforts.

Additionally, from May 29 through June 15 Wells Fargo customers can donate to the American Red Cross at Wells Fargo ATMs in Texas. Customers will not be charged a fee for using this service and 100 percent of the donations will be sent to the Red Cross. Wells Fargo Rewards® customers can redeem any amount of their redeemable rewards balance as a donation to American Red Cross Disaster Relief from May 29 through June 7 by accessing their rewards account at MyWellsFargoRewards.com or calling the Wells Fargo Rewards Service Center at 1-877-517-1358.

Two local non-profit organizations to share $500,000 in funding through Wells Fargo’s NeighborhoodLIFT® program to help revitalize neighborhoods, prevent veteran and family homelessness
SALT LAKE CITY – May 27, 2015

Wells Fargo & Company (NYSE: WFC), today announced grants totaling $500,000 for two nonprofits committed to assisting veterans and families in Salt Lake City overcome homelessness through the Wells Fargo NeighborhoodLIFT program.

The Road Home ($300,000) and The Community Foundation of Utah ($200,000) are receiving the grants to help prevent homelessness in Salt Lake City. The grant recipients were selected in close collaboration with Mayor Ralph Becker and the city’s division of Housing and Neighborhood Development to help address key local initiatives in the Salt Lake City community including homelessness prevention programs.

“I know support from the Wells Fargo NeighborhoodLIFT program will make a difference for Salt Lake,” Mayor Becker said. “My hope is that projects and programs funded by these grants will help Salt Lake be known as the community that makes sure that all of the homeless get the shelter and services they need and deserve.”

The combined $500,000 in grants is part of the Wells Fargo Salt Lake City NeighborhoodLIFT program that invested a total of $5 million to help boost homeownership in the community. The program is also helping create more than 200 Salt Lake homeowners with the help of a NeighborhoodLIFT program $15,000 down payment assistance grant after completing homebuyer education. Grants may be available for reservation by contacting NeighborWorks Salt Lake or a Salt Lake City-based Wells Fargo Home Mortgage consultant.

“We’re proud to do our part to help Salt Lake City neighborhoods,” said Dee O’Donnell, Wells Fargo regional president. “We believe these nonprofits are doing exceptional work in the community and these funds will add up to make a big impact for the Salt Lake City community.”

In Salt Lake City, the $15,000 down payment assistance grants were administered by NeighborWorks Salt Lake and awarded to eligible homebuyers with annual incomes that do not exceed 120 percent of the Salt Lake City area median income – which is about $82,450 for a family of four. Approximately 70 grants are still available for eligible homebuyers in the Salt Lake City area.

Since 2012, with a combined $242 million investment by Wells Fargo, LIFT programs have been introduced to 34 communities deeply affected by the housing crisis. The program has created nearly 9,500 homeowners, with the help of down payment assistance and homebuyer education. (NYSE: WCG), announced today that it gave $2,000 to the Southwestern Illinois Asthma Coalition (SWIAC) to send 120 children to the organization’s Asthma Blast Summer Camp in East Saint Louis, Ilinois. The SWIAC offers free half- and full-day camps to provide children who are six years old and older with asthma education through fun games and activities. It also educates the campers’ parents about asthma management to help them assist their children in developing the life-long habits needed to lead a healthy, active lifestyle.

As a part of Asthma Awareness Month, Harmony presented the check to SWIAC at its East St. Louis Asthma Kick-Off event. Track and field star, four-time Olympian, three-time gold medalist and SWIAC supporter, Jackie Joyner-Kersee shared a message at the event about her personal battle with asthma.

“I was in denial for a long time and I had to learn to respect the disease and take my medication regularly so the disease wouldn’t control me or my quality of life,” said Joyner-Kersee, who was diagnosed as a college freshman. “Asthma awareness is very important in helping children understand that asthma doesn’t have to prevent their athletic dreams. The SWIAC asthma camps will teach so many children facing the challenges of asthma to take their medication properly and to avoid potential asthma triggers.”

Asthma is one of the most common chronic pediatric diseases and affects approximately 9.6 million children across the country. National survey data collected by the Centers for Disease Control and Prevention indicate a disproportionately greater rate of asthma among children, women, blacks and those reporting income below the federal poverty level.

"In the St. Louis Metro region, asthma is the number one reason children are hospitalized,” said Amy Funk, asthma home assessment program coordinator for SWIAC. “In fact, East St. Louis falls within St. Clair County, which has the highest rate of asthma hospitalizations in the state. We thank Harmony WellCare for supporting our asthma camps and for making a significant difference in the lives of the children who will attend as a result of their contribution.”

Over 30 UTC Building & Industrial Systems employees volunteered their time for a recent Habitat for Humanity®project in Jupiter, Florida. Assisting with painting a three-bedroom, one-story stucco home, the volunteers worked tirelessly in the heat and humidity of south Florida, advancing the home towards completion.
 
As with every Habitat for Humanity project, the construction or refurbishment of the home, as well as painting and other needs, are completed entirely by volunteers. However, the family moving into the home is also required to contribute ‘sweat equity’ and fulfill over 200 hours of labor per able adult. The four-person family moving into the Jupiter home will begin a 30-year mortgage upon moving in, but they will not be required to provide a down payment.

The aircraft is scheduled to be delivered in July 2015 and will be outfitted to perform corporate and VIP transport in the region for Urban Development Group (UDG).

(NYSE: TXT) company, announced today a milestone sale and delivery of the first Bell 407GT to BBM Inc. to operate in the Middle East and Africa. The Bell 407GT is the armed version of the Bell 407GX, and will be used to perform a variety of missions including law enforcement and homeland security.

“We really wanted to give our customers a space that caters to their needs, and combine it with the Bell 429’s smooth, advanced performance,” said Patrick Moulay, vice president of global sales and marketing at Bell Helicopter. “Our customers in Russia are really responding to this aircraft with MAG’s luxurious cabin interior and we expect this sale is the first of many to come.

Customers can customize the cabin interior of the Bell 429 MAGnificent to a variety of seating configurations, and choose from a wide range of Italian fabrics, colors and optional equipment. MAG’s specialty custom interior incorporates two proprietary products, a passive noise abatement system called SILENS, and an In-Flight Entertainment Enhanced Lounge (I-FEEL), that provides a fully customized interactive touch screen based entertainment, communication and flight information management system.

(NYSE: TXT) company, announced today an agreement with JSC Ural Works of Civil Aviation (UWCA) for the development of final assembly capabilities by UWCA for the Bell 407GXP in order to support UWCA in obtaining Russian registry to facilitate their operations. Under the agreement UWCA agrees to purchase several Bell 407 GXP helicopters. The Bell 407GXP helicopters are planned to be delivered to UWCA by the end of 2015 from Bell and final assembled at the UWCA facility in Yekaterinburg.
